Terms of Service
The agreement between you and KibbleLab.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and KibbleLab LLC ("KibbleLab," "we," "us," or "our") governing your access to and use of the KibbleLab website, any applications we offer, and all related services (collectively, the "Service"). By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What KibbleLab Is
KibbleLab is a pet nutrition information service. We help pet owners identify commercially available pet foods that align with their pet's nutritional profile, based on published veterinary nutrition guidelines from recognized authorities including the World Small Animal Veterinary Association (WSAVA), the Association of American Feed Control Officials (AAFCO), and the Merck Veterinary Manual.
2. What KibbleLab Is Not - Important Disclaimers
KibbleLab is not a veterinary service, veterinary practice, medical device, or diagnostic tool. You acknowledge and agree that:
- Our food recommendations, scores, food-check results, nutritional analyses, recall alerts, insights, vet-shareable reports, health tracking tools, and educational content are informational tools only and do not constitute veterinary advice, medical advice, diagnosis, or treatment plans.
- The Service is not a substitute for professional veterinary care. For health decisions, diagnoses, treatment plans, or medical emergencies involving your pet, always consult a licensed veterinarian.
- Elimination diet protocols, sensitivity investigations, and symptom tracking features within the Service are informational aids and should be conducted under veterinary supervision.
- Health tracking data (weight trends, wellness check-ins, body condition assessments) are self-reported tools for your personal use and are not clinical measurements.
- Recall alerts are provided as a convenience and should not be relied upon as your sole source of recall information. We monitor the FDA's publicly available pet food recall database, but there may be delays between a manufacturer's recall and our notification.
- Nutraceutical and supplement information presented in food analyses may reflect amounts below therapeutic doses and should not be treated as medical supplementation.
- The Service does not provide emergency monitoring or urgent-care guidance. If you believe your pet may be experiencing a medical emergency, contact a licensed veterinarian or an emergency veterinary clinic immediately.
- KibbleLab is a consumer information tool for pet owners. It is not a medical device, and no aspect of the Service has been cleared or approved by any regulatory agency.
- Statements regarding pet nutrition on the Service have not been evaluated by the U.S. Food and Drug Administration (FDA) and are not intended to diagnose, treat, cure, or prevent any disease or health condition in animals.
2.1 Service Exclusions - Pets with Health Conditions
KibbleLab is designed for generally healthy pets without known medical conditions. The Service, including all food recommendations, scores, and the Concierge research report, is not intended for and should not be used for:
- Pets with diagnosed or suspected health conditions, diseases, or chronic illnesses.
- Pets currently taking prescription medications, veterinary-prescribed supplements, or receiving ongoing veterinary treatment.
- Pets on veterinary-prescribed therapeutic or prescription diets.
- Pets with diagnosed food allergies (as distinct from suspected sensitivities) that have been confirmed through veterinary diagnostic testing.
If your pet has any known health condition or is taking any medication, you must work directly with your veterinarian to determine appropriate dietary choices. By using the Service, you represent and warrant that you understand this exclusion and that you will not rely on KibbleLab's food recommendations or Concierge reports as a substitute for veterinary dietary guidance for pets with health conditions. KibbleLab assumes no liability whatsoever for any outcomes arising from use of the Service for pets that fall within these exclusions.
3. Your Acknowledgments and Responsibilities
By using the Service, you acknowledge and agree that:
- All information you provide to KibbleLab, including pet profile data, health information, and account details, is truthful, accurate, and complete. The quality and relevance of our recommendations depend on the accuracy of the information you provide.
- You are responsible for verifying that any food you select is appropriate for your specific pet, including checking the product packaging and ingredient list for allergens or ingredients your pet should avoid.
- You will consult your veterinarian before making significant dietary changes, beginning an elimination diet, or if your pet has any health condition that may be affected by diet.
- You understand that food formulations, ingredients, and availability change frequently, and you will verify current product information with the manufacturer or retailer before purchase.
- You accept sole responsibility for all feeding decisions you make for your pet, including decisions informed by the Service.
4. Eligibility
You must be at least 18 years of age and located in the United States to create an account or use the Service. By using the Service, you represent and warrant that you meet these requirements and have the legal capacity to enter into these Terms.
5. Accounts
Certain features of the Service (including the "Check a Food" tool) are available without creating an account. Creating an account provides access to additional features such as saving foods, creating pet profiles, health tracking, and personalized recommendations.
- You must provide accurate, current, and complete information during registration.
- You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must notify us immediately at support@kibblelab.com if you suspect unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms or are involved in fraudulent activity, and to close free accounts (accounts without an active paid subscription) that have been inactive for more than 24 consecutive months.
6. Service Plans, Subscriptions, and Payments
6.1 Free Plan
The Free plan is available at no cost and provides access to KibbleLab's core features, subject to usage limits (for example, monthly caps on food searches, comparisons, and vet reports, and a limit on the number of pet profiles). The specific features and current limits are shown in the app and on our site, and may change as the Service evolves (see Section 23).
6.2 KibbleLab+ Subscription
KibbleLab+ is a paid subscription that removes or raises the Free plan's usage limits and adds premium features. The features included and the current price are the ones presented on our site and at checkout at the time you subscribe, billed monthly or annually as selected at checkout.
- Automatic renewal: KibbleLab+ subscriptions renew automatically at the end of each billing period (monthly or annually) at the then-current rate unless you cancel before the renewal date.
- Renewal reminders: we will send you a reminder email at least once every 12 months that identifies your plan, the renewal charge amount and frequency, and how to cancel.
- Your consent: your subscription begins only after you affirmatively consent to these automatic renewal terms during checkout.
- Cancellation: you may cancel your subscription at any time through your account settings or by contacting support@kibblelab.com. Cancellation takes effect at the end of your current billing period. You will retain access to KibbleLab+ features until the end of the paid period. Online cancellation is available at any time and requires no more steps than signing up did.
- No refunds: we do not provide refunds or credits for partial billing periods, unused time, or unwanted renewals. It is your responsibility to cancel before the renewal date if you do not wish to continue.
- Price changes: we may change subscription pricing with at least 30 days' prior notice. Price changes take effect at the start of your next billing period following the notice. If you do not agree to a price change, you may cancel before it takes effect.
- Downgrade: if you cancel KibbleLab+, your account will revert to the Free plan at the end of your billing period. Your data (pet profiles, saved foods, logs, and reports) is preserved. Features included only in KibbleLab+ become locked or read-only previews, and Free plan limits apply to new activity (for example, adding another pet profile) until you re-subscribe.
- Where automatic renewal is restricted by law: if applicable law prohibits automatic renewal as described above, your subscription will instead continue as a prepaid month-to-month subscription, refundable for any unused full months.
6.3 Concierge Service
The Concierge service is a one-time purchase at the price presented at checkout. See Section 7 for full terms.
6.4 Payment Processing (Stripe)
All payments for KibbleLab+ subscriptions and Concierge purchases are processed by Stripe, Inc. ("Stripe"), a third-party payment processor. By making a purchase through the Service, you agree to be bound by Stripe's Terms of Service and Privacy Policy, which govern Stripe's collection and use of your payment information.
- Payment data: KibbleLab does not receive, process, or store your full credit card number, CVV/CVC, or bank account details. All sensitive payment data is transmitted directly to and stored by Stripe using PCI-DSS Level 1 compliant infrastructure. We receive only your payment method type (e.g., "Visa ending in 4242"), billing postal code, subscription status, and transaction history.
- Accepted methods: we accept credit cards, debit cards, Apple Pay, and Google Pay through Stripe. Available payment methods may vary by region.
- Billing management: you may view invoices, update your payment method, and manage your subscription through the Stripe Customer Portal, accessible from your KibbleLab account settings.
- Failed payments: if a recurring subscription payment fails, Stripe will automatically retry the charge according to its retry schedule. If payment cannot be collected after Stripe's retry attempts, your KibbleLab+ subscription may be suspended or downgraded to the Free plan. We are not responsible for any fees, overdraft charges, or penalties imposed by your bank or card issuer in connection with failed or retried payments.
- Disputes and chargebacks: if you believe a charge is incorrect, contact us at support@kibblelab.com before filing a dispute with your bank. Filing a chargeback without first contacting us may result in suspension of your account pending resolution. We reserve the right to terminate accounts associated with fraudulent chargebacks.
- Billing errors: if you believe you have been billed in error, notify us at support@kibblelab.com within 60 days of the charge so we can investigate and correct it. This does not limit any rights you may have with your card issuer.
- Currency: all prices are displayed and charged in U.S. dollars (USD). If your payment method is denominated in a different currency, your bank or card issuer may apply currency conversion fees. These fees are not controlled by or visible to KibbleLab.
- Stripe availability: KibbleLab is not responsible for any errors, outages, or service interruptions caused by Stripe. If Stripe is temporarily unavailable, you may be unable to complete a purchase or manage your subscription until service is restored.
7. Concierge Service Terms
The Concierge service is a research and information service. It consists of a structured data intake about your pet (species, breed, age, weight, health history, sensitivities, and dietary goals), followed by a research report generated using KibbleLab's food database and published nutritional guidelines. The report identifies commercially available food options that match your pet's profile criteria.
7.1 What the Concierge Report Is
- A research report presenting commercially available food options identified through KibbleLab's database search tools, filtered against the pet profile data you provide.
- An informational document compiled by individuals with pet nutrition education, including coursework through NAVC (North American Veterinary Community) programs and/or equivalent professional nutrition education.
- A convenience service that organizes publicly available product information into a structured, easy-to-read format for your personal use.
7.2 Eligibility for Concierge
The Concierge service is available only for generally healthy pets that are not currently under veterinary treatment, taking prescription medications, or on veterinary-prescribed diets. If your pet has a diagnosed health condition, food allergy confirmed by veterinary testing, or is taking medication, the Concierge service is not appropriate and you should work directly with your veterinarian for dietary guidance. By purchasing the Concierge service, you represent and warrant that your pet does not fall within these exclusions. If you provide inaccurate health information during the data intake process, any resulting report may be unsuitable and no refund will be issued.
7.3 What the Concierge Report Is NOT
- The Concierge report is not veterinary advice, a veterinary diagnosis, a medical treatment plan, a prescription, or a clinical recommendation.
- It is not a substitute for professional veterinary care. No aspect of the Concierge service constitutes the practice of veterinary medicine.
- The report does not diagnose, treat, cure, or prevent any disease, illness, allergy, or health condition in any animal.
- The individuals preparing the report are not veterinarians, licensed veterinary technicians, or licensed medical professionals. They do not prescribe medications, diagnose conditions, order laboratory tests, or provide medical treatment plans.
- The food options presented in the report are not guaranteed to be suitable for your specific pet. Individual animals may react differently to any food, regardless of its nutritional profile. You must consult your veterinarian before making dietary changes based on the report.
7.4 Deliverables
The Concierge report includes: a summary of your pet's profile and dietary criteria as provided by you; a curated list of at least 3 food options from our database with ingredient and nutritional breakdowns; suggested portion guidelines based on published feeding charts for your pet's weight, age, and activity level; a general food transition timeline based on standard veterinary guidance; a reference sheet you may share with your veterinarian; and one follow-up report revision within 30 days of delivery.
7.5 Your Responsibilities
- The quality and relevance of the report depend entirely on the accuracy and completeness of the information you provide. You are solely responsible for providing truthful, accurate, and complete pet profile data.
- You are responsible for reviewing the report with your veterinarian before acting on any information contained in it.
- You are responsible for verifying all product information (ingredients, formulations, availability) directly with the manufacturer or retailer, as formulations may have changed since our database was last updated.
- You accept sole responsibility for all feeding decisions you make for your pet, including any decisions informed by the Concierge report.
7.6 Limitation of Liability for Concierge
TO THE FULLEST EXTENT PERMITTED BY LAW, KIBBLELAB LLC, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND ANY INDIVIDUALS WHO PREPARE CONCIERGE REPORTS SHALL NOT BE LIABLE FOR ANY ADVERSE REACTIONS, ALLERGIC RESPONSES, ILLNESS, INJURY, WEIGHT CHANGES, DIGESTIVE ISSUES, DEATH, OR ANY OTHER HEALTH OUTCOMES EXPERIENCED BY ANY ANIMAL AS A RESULT OF DIETARY CHANGES MADE BASED ON, INFORMED BY, OR RELATED TO THE CONCIERGE REPORT. THE CONCIERGE REPORT IS AN INFORMATIONAL RESEARCH DOCUMENT, NOT MEDICAL ADVICE, AND IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND.
7.7 Delivery, Cancellations, and Refunds
- Delivery: reports are delivered within 3 business days of your submitting the pet profile (intake questionnaire) to the email associated with your account. The turnaround period begins when you submit your completed profile, not at the time of purchase.
- Cancellations: research and report preparation begin when you submit your completed pet profile (intake questionnaire). You may cancel for a full refund at any time before you submit your profile. Once you submit your profile, work begins immediately and the engagement cannot be cancelled; by submitting your profile you acknowledge that work begins immediately and you waive any right to cancel or receive a cooling-off period refund from that point forward.
- Follow-up: your one report revision must be requested within 30 days of initial delivery. Unused revisions do not carry over, transfer, or entitle you to a refund.

in the following circumstances:
- We fail to deliver the report within 3 business days of your submitting your completed pet profile.
- We exercise our right to decline the engagement (see Section 7.8 below), in which case a full refund will be issued.
7.8 Our Right to Decline
KibbleLab reserves the right to decline any Concierge engagement and issue a full refund if, upon reviewing your intake data, we determine that:
- Your pet has a diagnosed or suspected health condition, disease, or chronic illness.
- Your pet is currently taking prescription medications or receiving ongoing veterinary treatment.
- Your pet is on a veterinary-prescribed therapeutic or prescription diet.
- The information you provided is incomplete, inaccurate, or insufficient to produce a meaningful report.
- Your request falls outside the scope of what our food database and research tools can reasonably address.
In the event we decline the engagement, we will notify you by email and process a full refund within 7 business days. We are under no obligation to explain the specific reason for declining beyond confirming that your request fell outside our service scope.
7.9 Exclusive Remedy
To the fullest extent permitted by law, your sole and exclusive remedy for dissatisfaction with, or any defect in, a Concierge report is, at our election, the included report revision described in Section 7.4 or a refund of the Concierge fee, and our total liability arising out of the Concierge service will not exceed the amount you paid for it.
8. Content Accuracy and Food Database
- Food scores, nutritional analyses, and educational articles are based on published veterinary science and nutritional data provided by pet food manufacturers.
- Product details, including ingredient lists, nutritional information, and guaranteed analyses, have not been independently verified by KibbleLab. This data is sourced from manufacturers and publicly available product information. For the most current and accurate product information, refer to the product packaging or contact the manufacturer directly.
- We update our food database regularly; however, pet food formulations, ingredients, and nutritional profiles can change without notice from the manufacturer.
- We are not responsible for manufacturer labeling errors, undisclosed ingredient changes, inaccurate nutritional data supplied by manufacturers, or discrepancies between a product's label and its actual contents.
- KibbleLab is not responsible for any adverse reactions, allergic responses, or health issues that may result from feeding any product listed in our database.
- Blog articles and educational content ("KibbleLab Explains") are written and reviewed by individuals with professional nutrition education and are based on published veterinary nutrition guidelines. They are for informational purposes only.
- The pet food landscape changes frequently. Information that was accurate at the time of publication may become outdated. We make reasonable efforts to keep content current but do not guarantee that all information is current at all times.
8.1 Scores Are Editorial Opinions
KibbleLab's food scores, ratings, and product commentary are editorial opinions. Scores are generated by applying KibbleLab's disclosed, criteria-based methodology to ingredient lists, guaranteed analyses, and other product information as published by the manufacturer, which we take in good faith from publicly available sources. The weighting of those criteria reflects the judgment of KibbleLab's editorial team. KibbleLab does not laboratory-test products. A score is not a representation that feeding a particular product will produce any specific dietary response or health outcome for your pet, and a higher-scored food is not necessarily more suitable for your specific pet than a lower-scored food.
8.2 Derived Figures
Calorie targets, portion estimates, price-per-day figures, and similar numbers presented on the Service are derived from published data and standard published formulas, and may involve extrapolation. They are provided for comparison purposes only and are not a substitute for the feeding guide on the product's packaging or for your veterinarian's guidance.
8.3 Health-Feature Filters
Where the Service allows you to filter or search foods by health-related features (for example, joint care or digestive health), results are based on claims and product descriptions published by the manufacturers of those foods. KibbleLab relays those claims in good faith, does not verify or endorse them, and accepts no responsibility for their accuracy or their relevance to your specific pet.
8.4 Corrections
We present our product data and commentary in good faith and intend for them to be accurate. If you believe any material fact on the Service is in error, including if you represent a brand or manufacturer, contact support@kibblelab.com with verifiable supporting information. We review these reports and correct material errors.
9. Affiliate Links, Advertising, and Third Parties
The Service includes affiliate links to third-party retailers and other partners through which you may purchase products or services. These are affiliate links, meaning KibbleLab may earn a commission on qualifying purchases or sign-ups made through them, at no additional cost to you. The Service may also display clearly labeled advertising and sponsored placements from third parties, including within or alongside results.
- A company cannot pay for a higher score or for inclusion in or exclusion from our database, and neither affiliate relationships nor sponsorships ever influence a product's score. Sponsored placements are always clearly labeled and display the same KibbleLab score shown everywhere else. Our entire food database is available to all users regardless of whether a given product generates affiliate or advertising revenue.
- When you click an affiliate link, you leave the KibbleLab Service. Your purchase or sign-up is governed by the third party's terms, conditions, and privacy policy. We have no control over and assume no responsibility for the products, services, content, or practices of third parties.
- Product availability, pricing, and shipping on third-party retailer sites are determined by those retailers and may differ from information displayed on KibbleLab.
10. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Scrape, crawl, copy, harvest, or otherwise extract data from our food database, scoring algorithms, or proprietary content through automated or manual means.
- Reverse-engineer, decompile, or disassemble any aspect of the Service, including our proprietary food scoring system.
- Misrepresent KibbleLab content, recommendations, or reports as veterinary advice, medical advice, or professional clinical guidance.
- Create accounts for automated, programmatic, or commercial data collection purposes.
- Impersonate another person, misrepresent your affiliation with any entity, or provide false information.
- Attempt to gain unauthorized access to the Service, other users' accounts, or our computer systems or networks.
- Transmit viruses, malware, or any other malicious code through the Service.
- Use the Service in any manner that could damage, disable, overburden, or impair our servers or interfere with other users' access.
- Reproduce, distribute, publicly display, or create derivative works based on KibbleLab content without our prior written permission.
We reserve the right to suspend or terminate your account, without notice or refund, for violations of this section.
10.1 Veterinary and professional accounts
Some accounts are granted access to a professional workspace for veterinarians and other veterinary practice staff. Access is granted by KibbleLab after review, is personal to the individual it is granted to, and may be revoked at any time.
The workspace includes a feature that emails a list of foods you selected to an email address you enter. Each time you use it, you confirm that the person at that address is your client or their authorized representative and that they asked you to send them the list. By using it you additionally agree that:
- You will not use it to send marketing, promotional, or bulk messages of any kind, and you will not enter an address obtained from a purchased, rented, scraped, or otherwise third-party list.
- You will enter only addresses given to you by the client for the purpose of communicating about their animal's care, and you are responsible for the accuracy of every address you enter.
- You will honor a client's request to stop, and you understand that a recipient who uses the opt-out link in one of these messages will not receive further lists from any veterinarian using KibbleLab.
- Any patient name or note you enter is your own clinical note. You are responsible for what you write, for the consents you hold under applicable law and your professional obligations, and for keeping information you would not want disclosed out of a message sent to a third party.
- The lists this feature produces are generated from published ingredient labels and our scoring. They are not clinical recommendations, and nothing in the workspace establishes a veterinarian-client-patient relationship between KibbleLab and anyone.
Sends are subject to volume limits. We may suspend a professional account's sending, or the account itself, without notice, if we believe this section has been violated or if the messages sent from it generate complaints.
11. Intellectual Property
- All content on the Service, including but not limited to text, graphics, logos, mascot illustrations, button icons, images, audio clips, data compilations, food scores, nutritional analyses, and software, is the property of KibbleLab LLC or its content suppliers and is protected by United States and international intellectual property laws. "Intellectual Property Rights" includes all patents, copyrights, moral rights, trademarks, trade names, service marks, domain names, trade dress, goodwill, trade secrets, database rights, rights in designs, rights in computer software, rights in confidential information (including know-how), and all other intellectual property rights, in each case whether registered or unregistered, including all applications and renewals thereof, in any part of the world.
- We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms. This license does not include any right to resell or make commercial use of the Service or its contents; collect or use any food data, product listings, scores, or descriptions for commercial purposes; make derivative works of any Service content; or download, copy, or otherwise exploit Service content for the benefit of any third party.
- You may share links to KibbleLab pages and content for personal, non-commercial purposes. You may not reproduce, redistribute, modify, or create derivative works from our content without prior written consent.
- Vet-shareable reports generated through the Service are intended for your personal use and to share with your pet's veterinary care team. You may not use them for commercial purposes.
12. User Content and Pet Data
- You retain ownership of the personal information and pet data you provide to the Service (including pet profiles, health logs, photos, and symptom journals).
- By creating an account and submitting account, pet, usage, or other content to the Service, you grant KibbleLab a non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, process, and store that content to provide, secure, improve, and develop the Service and to create aggregate or de-identified information. This data-use permission is a condition of using the Service, not an optional consent. The license to identifiable content ends when that content is deleted, except where retention is legally permitted or required; the license survives for information that has been genuinely de-identified and can no longer reasonably be linked to you, your household, or your devices.
- You represent that you have the right to provide any content you submit and that it does not violate any third party's rights.
- We may retain, use, share, sell, or license genuinely de-identified data and aggregate statistics derived from user content for analytics, research, product development, service improvement, and commercial purposes, as described in our Privacy Policy. We publicly commit not to re-identify this information except to test our de-identification process, and we require recipients not to re-identify it.
- Any reviews, ratings, or similar content you submit must be based on your genuine personal experience with the product or service reviewed and must not be intentionally false or misleading. If you have a material connection to a brand, manufacturer, or retailer (for example, employment or compensation), you must disclose it.
- We have no obligation to monitor, publish, preserve, or continue displaying any content you submit, and we may remove, edit, or decline to publish content at any time without liability to you.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KIBBLELAB DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY FOOD DATA, NUTRITIONAL INFORMATION, SCORES, RECOMMENDATIONS, OR OTHER CONTENT PROVIDED THROUGH THE SERVICE.
- WARRANTIES THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.
FOOD RECOMMENDATIONS AND NUTRITIONAL INFORMATION ARE BASED ON PUBLISHED GUIDELINES AND MANUFACTURER-PROVIDED DATA, WHICH MAY CONTAIN ERRORS OR BECOME OUTDATED. YOU ACKNOWLEDGE THAT YOU USE THE SERVICE AT YOUR OWN RISK.
14. Limitation of Liability
The Service is provided for personal, domestic, and non-commercial use only. We will have no liability to you for any loss of profit, loss of business, business interruption, loss of business opportunity, or any commercial or economic losses of any kind arising from your use of the Service.
We are not responsible for any loss or damage that is not reasonably foreseeable. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time you agreed to these Terms, both you and we knew it might happen.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- KIBBLELAB, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, AND ANY INDIVIDUALS INVOLVED IN PREPARING CONCIERGE REPORTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- KIBBLELAB IS NOT LIABLE FOR ANY ADVERSE REACTIONS, ALLERGIC RESPONSES, ILLNESS, INJURY, DEATH, OR OTHER HEALTH OUTCOMES EXPERIENCED BY ANY PET AS A RESULT OF FOOD CHOICES MADE USING THE SERVICE. PET FOOD SELECTION AND FEEDING DECISIONS ARE SOLELY YOUR RESPONSIBILITY.
- KIBBLELAB IS NOT LIABLE FOR DELAYS IN RECALL NOTIFICATIONS, INACCURACIES IN MANUFACTURER-PROVIDED DATA, OR CHANGES IN FOOD FORMULATIONS THAT OCCUR BETWEEN DATABASE UPDATES.
- OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO KIBBLELAB IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
15. Indemnification
You agree to indemnify, defend, and hold harmless KibbleLab LLC, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) pet food choices or feeding decisions you make based on information obtained through the Service; or (e) any content you submit to the Service.
16. Dispute Resolution
16.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact us at legal@kibblelab.com and attempt to resolve the dispute informally for at least 30 days. Your written complaint must describe the dispute on an individual basis and be personally signed by you (and by your counsel, if you are represented).
16.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the state of the respondent's residence (for claims by you) or in the State of Florida (for claims by KibbleLab). The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Any arbitration demand must be personally signed by the party filing it and, if that party is represented by counsel, also by counsel.
16.3 Class Action Waiver
YOU AND KIBBLELAB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
16.4 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Claims within the jurisdiction of small claims court may also be brought in small claims court in lieu of arbitration.
16.5 Your Right to Opt Out of Arbitration
You may opt out of the arbitration requirement in Section 16.2 and the class action waiver in Section 16.3 by sending an email to legal@kibblelab.com within 30 days after you first accept these Terms. Your opt-out notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. This is the only way to opt out. If you validly opt out, disputes will be resolved in the courts described in Section 17, and the remainder of these Terms continues to apply to you.
16.6 Coordinated Filings
If 25 or more arbitration demands of a substantially similar nature are filed against KibbleLab within a 90-day period by or with the assistance of the same or coordinated counsel or organizations, the demands will be administered in batches of up to 50 demands per batch, with one arbitrator appointed and one set of administrative and filing fees due per side for each batch, under the AAA's rules and procedures for mass or coordinated filings then in effect. All applicable statutes of limitations are tolled for each batched demand from the date it is filed until the batch containing it concludes. The outcome of any batch binds only the parties to the demands in that batch and has no preclusive effect on any other demand.
16.7 Jury Trial Waiver
To the extent any dispute between you and KibbleLab proceeds in court rather than in arbitration, you and KibbleLab each waive, to the fullest extent permitted by applicable law, the right to a trial by jury.
16.8 Changes to This Section
Changes we make to this Section 16 do not apply to any dispute for which either party has already provided notice under Section 16.1 or filed an arbitration demand. If you previously opted out under Section 16.5, your opt-out remains effective, and a change to this Section 16 does not restart the opt-out window for users already bound by an earlier version of these Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction and venue of the state courts located in Pinellas County, Florida, and the United States District Court for the Middle District of Florida.
18. Termination
- By you: you may terminate your account at any time by contacting support@kibblelab.com. Termination does not entitle you to a refund of any prepaid fees.
- By us: we may suspend or terminate your account at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms. In the case of termination for cause, no refund will be provided.
- Effect of termination: upon termination, your right to use the Service ceases immediately. Sections 2, 3, 11, 12, 13, 14, 15, 16, 17, 19-22, and 24-27 of these Terms survive termination.
19. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and KibbleLab regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether oral or written.
21. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any term shall not be deemed a further or continuing waiver of such term or any other term.
22. Force Majeure
KibbleLab shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet or infrastructure failures, cyberattacks, or acts of third parties.
23. Changes to the Service; Beta Features
We may add, change, suspend, or discontinue any feature of the Service at any time. To the fullest extent permitted by law, we will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Service or of any feature. If you believe a change has materially reduced the value of a paid plan during a period you have already paid for, contact support@kibblelab.com.
Features labeled beta, preview, experimental, or early access are provided as-is for evaluation, may be less accurate or reliable than other features, may change without notice, and may be withdrawn at any time.
24. Electronic Communications and Notices
By using the Service, you consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically (by email to the address associated with your account, or by posting within the Service) satisfy any legal requirement that such communications be in writing. Notices to KibbleLab required by these Terms must be sent by email to legal@kibblelab.com and are effective when received.
25. Assignment; No Third-Party Beneficiaries
You may not assign or transfer these Terms or your account without our prior written consent, and any attempted assignment without consent is void. We may assign these Terms without your consent to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. Except as expressly stated in Sections 7.6 and 14, these Terms do not confer any rights on any third party.
26. Geographic Scope
The Service is operated from the United States and is intended for users located in the United States. We do not represent that the Service or its content is appropriate or available for use in any other location, and we may restrict access to the Service from other locations. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
27. Notice to California Users
Under California Civil Code Section 1789.3, California users of the Service are entitled to the following notice: the Service is provided by KibbleLab LLC, P.O. Box 24, Gladeville, TN 37071. Questions, complaints, or requests for further information may be sent to support@kibblelab.com. Pricing for paid plans is described in Section 6. California residents may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
28. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email (sent to the address associated with your account) and/or by placing a prominent notice on our Service at least 30 days prior to the changes taking effect. The "Last updated" date at the top of this page indicates when the Terms were most recently revised. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account.
